Shipping Policy

Daya Stone ("we", "our", "us") is committed to providing transparent, reliable and compliant logistics services to all clients. This Shipping Policy sets out your and our rights and obligations in accordance with: • the European Union Consumer Rights Directive 2011/83/EU, Regulation (EU) 2019/1020 on market surveillance and product compliance, and related national legislation; and • the E‑commerce Law of the People’s Republic of China, the PRC Consumer Rights Protection Law and other applicable Chinese regulations.

By placing an order with us, you agree to the terms below. Nothing in this Policy limits any mandatory rights you may enjoy under applicable law.

1. Order Processing

1.1 Confirmation. All purchase orders are confirmed in writing. Once we have received full technical specifications, approved drawings and the agreed advance payment, we will issue an Order Confirmation that includes the planned dispatch window.

1.2 Lead‑time. The standard lead time for stock items is 5‑7 business days. Made‑to‑order or customised stone products generally require 20‑40 calendar days, depending on volume and finishing requirements. Where lead times exceed 30 calendar days, you will receive written notice and the right to cancel the order at no cost.

1.3 Changes. Requests for changes after the Order Confirmation may affect lead time and cost. We will inform you of any revised schedule and seek your written acceptance before proceeding.

2. Shipping Methods & Incoterms®

2.1 We offer FOB Xiamen, CIF main European ports, DAP named place or other Incoterms® 2020 options as quoted in your Proforma Invoice.

2.2 Transport modes include sea freight (FCL/LCL), rail freight (China‑Europe Railway), and air freight for urgent samples. The default carrier is selected by us for cost‑effectiveness and reliability unless you nominate your own forwarder in writing.

3. Shipping Costs

3.1 Quoted prices are exclusive of shipping unless expressly stated. Shipping charges are calculated on a cost+insurance+freight basis and itemised on your final invoice.

3.2 If you arrange pick‑up under EXW or FCA terms, you bear all transport costs and risks from the handover point.

4. Customs, Duties & Taxes

4.1 For EU customers, import VAT and any local duties are your responsibility unless the order is sold on a DDP or IOSS basis. Professional importers must ensure they hold a valid EORI number.

4.2 For non‑EU customers, local customs rules apply. We provide all standard export documentation (commercial invoice, packing list, bill of lading, certificate of origin, EN 15285 test reports where applicable).

4.3 We are not liable for delays caused by customs inspections but will assist with any additional paperwork reasonably requested.

5. Delivery Timeframes

5.1 Indicative transit times once goods leave Xiamen Port: • Northern Europe (e.g. Rotterdam, Hamburg): 28‑35 days • Mediterranean (e.g. Genoa, Barcelona): 23‑30 days • UK (Felixstowe, London Gateway): 30‑35 days • Rail Freight to Duisburg: 16‑20 days

5.2 Force majeure events—such as extreme weather, strikes, epidemics or carrier capacity shortages—may extend delivery times. We will notify you as soon as reasonably practicable.

6. Tracking & Proof of Delivery

6.1 We email the master bill of lading number or rail waybill once the goods are loaded.

6.2 For courier shipments, a tracking link is provided. Larger consignments are tracked via carrier portal updates.

6.3 Delivery shall be deemed completed when the shipment is placed at your disposal according to the agreed Incoterm.

7. Inspection & Acceptance

7.1 Visual check on arrival. You (or your nominated agent) must examine the packaging upon delivery. Note any visible damage on the carrier’s receipt and photograph the condition before unpacking.

7.2 Hidden damage/shortage. Notify us in writing within 72 hours of delivery with supporting photos and the signed carrier receipt. Failure to do so may affect your right to claim.

7.3 Third‑party QC. We welcome pre‑shipment or post‑arrival inspections by SGS, TÜV or other accredited bodies at your cost.

8. Right of Withdrawal (EU Consumers Only)

8.1 If you are a consumer residing in the European Union, you have the right to withdraw from the contract within 14 days after delivery, without giving any reason, under Article 9 of Directive 2011/83/EU.​

8.2 The right of withdrawal does not apply to goods that are made to the consumer’s specifications or are clearly personalised (e.g., cut‑to‑size slabs, bespoke finishes).​

8.3 To exercise the right, send a clear statement to info@dayastone.com within the 14‑day period. We will refund all payments received, including the original outbound shipping cost (standard rate only), within 14 days after we receive the returned goods or proof of their return.​

8.4 You bear the direct cost of returning the goods. Items must be returned in their original condition and secure packaging.

9. Returns & Replacement for Logistics Damage

9.1 Where damage or shortage is verified in accordance with Section 7, we will, at our discretion, (a) replace the affected goods at no additional cost; (b) issue a partial refund; or (c) provide a credit note against your next order.​

9.2 Any replacement will be produced and shipped on an expedited schedule where feasible.

10. Undeliverable or Refused Shipments

10.1 If a shipment is returned because it is undeliverable or you refuse delivery for reasons not attributable to us, you will be responsible for all return freight, storage and any additional duties or taxes incurred.

11. Compliance With Safety & Environmental Regulations

11.1 All products conform to EN 1469, EN 12057 or EN 12058 (as applicable) and meet the EU REACH Regulation for natural stone.​

11.2 We comply with China’s "Measures for the Administration of Import and Export of Goods" and the "Law on the Prevention and Control of Environmental Pollution by Solid Wastes" during production and packing.

12. Limitation of Liability

To the fullest extent permitted by law, our liability for any loss or damage arising out of or relating to this Policy shall be limited to the purchase price of the affected goods. Nothing in this clause seeks to exclude or limit liability for death, personal injury, fraud or gross negligence.

13. Governing Law & Dispute Resolution

13.1 B2B Transactions. Unless otherwise agreed, contracts are governed by the United Nations Convention on Contracts for the International Sale of Goods (CISG) together with the laws of the People’s Republic of China. Disputes shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC), Xiamen Sub‑Commission, in English.​

13.2 EU Consumers. You may bring proceedings in the courts of the EU Member State where you reside. The European Commission’s Online Dispute Resolution (ODR) platform is available at ec.europa.eu/consumers/odr.

15. Updates to This Policy

We may update this Shipping Policy from time to time to reflect changes in law, logistics partners or our operations. Any changes take effect upon posting on this page. If the amendments materially affect your rights, we will notify you by e‑mail or other prominent notice at least 14 days before they become effective.
